Affordable housing in Maplewood Seeks to Avoid ‘Unnecessary Litigation’

Maplewood is actively working to finalize its Fourth Round Housing Element and Fair Share Plan, aiming to create 216 new affordable housing units by 2035.
However, the township faces challenges in meeting this goal and addressing litigation from both a developer and the Fair Share Housing Center before the March 15 deadline.
On February 10, the Maplewood Planning Board voted 7-1 against adding 11 Inwood Place to the Movie Theater Redevelopment Area in Maplewood Village.
Mayor Vic De Luca was the sole supporter of the addition.
Following this decision, the township's Special Affordable Housing Counsel requested an extension in litigation initiated by 161 Maplewood Investors, LLC.
The developer seeks to build a 65-unit building, including 13 affordable units, on the Bank of America parking lot and 11 Inwood Place.
The Planning Board's vote necessitated an amended Housing Element and Fair Share Plan filed on February 13, reducing the developer's project to 50 units.
To avoid unnecessary litigation, township representatives met with the developer on February 17 to seek an amicable resolution.
The meeting was productive, but both parties agreed that the March 15 deadline does not provide sufficient time to negotiate a revised settlement.
Therefore, they have jointly requested a 90-day extension to allow for further negotiations.
Without this extension, the township would have to proceed with the current amended plan, likely resulting in additional litigation.
The Fair Share Housing Center has been informed and does not object to this approach.
Maplewood's elected leaders remain committed to fulfilling their affordable housing obligations.
At the February 10 Planning Board meeting, Mayor De Luca emphasized the township's proactive stance, stating, "Unlike some towns, we have not shirked our responsibility in doing affordable housing."
He highlighted the importance of adapting to changing rules and the need to look at the big picture for Maplewood.
The Maplewood Planning Board is scheduled to consider the amended Housing Element and Fair Share Plan at a special meeting on February 26.
